General Terms and Conditions
I. Preamble
The entity responsible for this website is Sport Laurin KG, d. Näckler Anna & Co (hereinafter: Skidelivery Dolomites).
II. Services of Skidelivery Dolomites
Skidelivery Dolomites is a web-based reservation and booking system for the reservation and booking of skis, ski sets, snowboards, snowboard sets, ski boots, snowboard boots, helmets, poles, protectors, and various additional equipment (hereinafter: winter sports equipment). The winter sports equipment shown on the Skidelivery Dolomites website and available for booking is provided by the respective rental shops. Skidelivery Dolomites is available for questions related to bookings via the Skidelivery Dolomites website. For other concerns (such as delivery, pick-up, or questions regarding the winter sports equipment), the respective rental shop must be contacted.
III. Contract Formation
The rental agreement for the respective winter sports equipment is concluded exclusively between the booking customer and the respective rental shop. Skidelivery Dolomites acts solely as an intermediary. Therefore, the contact person in relation to the rental of winter sports equipment is the respective rental shop. The general terms and conditions of the rental shop may apply to the contract concluded between the customer and the rental shop.
IV. Services of the Rental Shop
The rental shop provides the rented winter sports equipment to the customer and is obligated to make the equipment available for the agreed rental period. The rental shop ensures the delivery of the rented winter sports equipment to the location agreed between the customer and the rental shop (e.g., the ski room of the hotel) and ensures the collection of the equipment from the same location at the end of the rental period.
V. Booking
After completing the booking process, the customer will receive a booking confirmation from Skidelivery Dolomites via the email address provided by the customer. If the customer’s details are complete, no separate contact will be made by the rental shop.
VI. Delivery/Pick-Up
The rented winter sports equipment will be provided by the rental shop in the ski room of the hotel specified by the customer by 8:00 AM on the first day of the rental period. At the end of the rental period (on the evening of the last day of the rental), the customer must return the equipment to the ski room of the hotel by 6:00 PM, where it will be collected by the rental shop.
VII. Cancellation
The customer has the option to cancel or modify the booking free of charge up to 48 hours before the start of the rental period for winter sports equipment (for changes, see point VIII:), minus the payment provider’s fees of 2.5% of the booking amount + €0.25 per booking. To do this, Skidelivery Dolomites must be informed in due time via email at booking@skidelivery-dolomites.it or through www.skidelivery-dolomites.it/conctact/.
It should be noted that, according to Art. 55 para. 1 lit. b of the Consumer Code, there is no legal right of withdrawal for the provision of services related to leisure activities.
It is also noted that, in principle, cases of force majeure, unfavorable weather conditions, or other factors beyond the control of Skidelivery Dolomites do not entitle the customer to a free cancellation of the booking.
a. Cancellation due to illness/accident
In the event of the customer’s illness or injury during the rental period, a refund of the rental price is possible, minus the payment provider’s fees of 2.5% of the booking amount + €0.25 per booking, for the amount exceeding the actual usage period, provided the winter sports equipment is promptly returned to the rental shop and a medical certificate is presented to Skidelivery Dolomites. This applies exclusively to the person directly affected by the illness or injury.
b. Cancellation without reason
For cancellations made within 48 hours of the start of the rental period for reasons other than illness or injury, a cancellation fee of 100% of the rental price applies.
If the customer does not pick up the booked equipment on time or at all, no refund will be issued. The same applies if the customer returns the equipment early.
VIII. Modifying the Rental Period of a Booking
The customer can change the rental period of a booking up to 48 hours before the original rental period begins, subject to the availability of winter sports equipment. If the rental period is extended, the customer will be required to pay the additional rental fee immediately. If the rental period is shortened, a refund will be issued by Skidelivery Dolomites.
IX. Modifying the Winter Sports Equipment in a Booking
The customer may change the winter sports equipment booked up to 48 hours before the original rental period begins. Depending on whether products are added or removed, the customer will either be required to pay an additional fee or will receive a refund from Skidelivery Dolomites.
a. Additional Payments/Refunds
If the total amount of the booking changes as a result of a modification by the customer, the following applies:
Additional Payment: If the new amount exceeds the original booking amount, the customer can pay the difference using one of the available payment methods and will receive an updated booking confirmation after successful payment.
The original booking remains valid until the customer has completed the payment. After that, it will be canceled.
Refund: If the new amount is less than the original booking amount, the customer will receive confirmation by email after the booking change, indicating that the difference will be refunded by Skidelivery Dolomites. The refund will be issued within five working days using the customer’s selected payment method.
X. Applicable Law / Jurisdiction
Italian law applies exclusively to disputes related to online bookings via Skidelivery Dolomites. The competent court is the registered office of Skidelivery Dolomites.
XI. Disclaimer of Liability
Since Skidelivery Dolomites acts solely as an intermediary between the customer and the respective rental shop and is therefore not responsible for fulfilling the rental agreement, the customer cannot make claims for damages against Skidelivery Dolomites (except in cases of intent or gross negligence).
